Purpose

These Terms and Conditions of Sale (hereinafter the "Terms") govern the sale of online courses offered by Morgann Riu, sole trader (micro-enterprise), through the morgannriu.fr website.

The courses cover the fields of cybersecurity, Linux administration and DevOps. They are available as pre-recorded video courses and live training sessions.

Any order implies the buyer's unreserved acceptance of these Terms.

Products and services

The products offered for sale are:

  • Video courses: pre-recorded learning content on cybersecurity, Linux and DevOps, accessible online after purchase
  • Live sessions: live training delivered by video conference on scheduled dates
  • Course bundles: combinations of several courses at a reduced price

The essential features of each course (detailed content, duration, prerequisites, difficulty level) are described on the corresponding presentation page. The buyer is required to review them before placing any order.

Pricing

Prices are stated in euros (EUR) and are inclusive of all taxes.

In accordance with Articles 293 B et seq. of the French General Tax Code, Morgann Riu, as a sole trader, is not subject to VAT. The notice "VAT not applicable, Article 293 B of the CGI" appears on every invoice.

Prices may be changed at any time. The applicable price is the one in effect at the time the order is confirmed. Promotional offers are valid only for their stated duration.

Ordering and payment

The ordering process is as follows:

  1. Selecting the course on the morgannriu.fr website
  2. Redirection to the secure Stripe Checkout payment page
  3. Entering payment details and confirming
  4. Order confirmation by email

Payment is made online by bank card (Visa, Mastercard, American Express) through the secure Stripe platform. Morgann Riu never has access to your banking details, which are processed directly by Stripe in a secure environment compliant with the PCI-DSS Level 1 standard.

The order is deemed confirmed once payment has been validated by Stripe. A confirmation email is sent to the address provided at the time of purchase.

Access to courses

Video courses: access is immediate once payment is confirmed. An access link is sent by email to the address provided at the time of purchase.

Live sessions: connection details (video conference link, date, time) are sent by email after payment is confirmed and no later than 24 hours before the scheduled session.

Access to the courses is personal and non-transferable. It is tied to the email address used at the time of purchase.

Right of withdrawal

In accordance with Articles L.221-18 et seq. of the French Consumer Code, the buyer has a period of 14 days from the date of purchase to exercise their right of withdrawal, without having to give reasons or pay penalties.

However, in accordance with Article L.221-28, 13° of the French Consumer Code, the right of withdrawal may not be exercised for digital content supplied on an intangible medium where performance has begun with the consumer's express prior consent and their express waiver of their right of withdrawal.

If the buyer accesses a video course immediately after purchase and has expressly consented to this immediate performance, the right of withdrawal is deemed to have been waived for that course.

To exercise their right of withdrawal, the buyer must send their request by email to [email protected], stating their name, the course concerned and the date of purchase. The refund is issued within 14 days of receipt of the request, using the same payment method as the one used at the time of purchase.

Satisfaction guarantee

Independently of the statutory right of withdrawal, Morgann Riu offers a 30-day satisfaction guarantee.

If the course does not meet your expectations, you may request a full refund within 30 days of your purchase, with no conditions. The refund request must be made by email to [email protected] or via the contact form.

The refund is issued within 14 business days using the same payment method as the one used at the time of purchase.

Intellectual property

All course content (videos, materials, source code, exercises, learning documents) is protected by copyright and remains the exclusive property of Morgann Riu.

Purchasing a course grants a personal, non-exclusive and non-transferable right of use. It is strictly forbidden to:

  • Reproduce, copy or duplicate the course content
  • Redistribute, resell or share access with a third party
  • Publicly disseminate the content in any form whatsoever
  • Record live sessions without prior written authorization
  • Use the content for commercial or competing training purposes

Any breach of these provisions may result in the immediate suspension of access to the course and legal proceedings in accordance with Articles L.335-2 et seq. of the French Intellectual Property Code.

Liability

Morgann Riu undertakes to provide quality courses that comply with the descriptions published on the website. However, Morgann Riu cannot be held liable in the event of:

  • Misuse or misinterpretation of the course content
  • Damage resulting from applying the techniques taught without the necessary precautions
  • Temporary interruption of access due to maintenance or an event of force majeure
  • Technical incompatibility with the buyer's equipment

The courses are provided for educational purposes. Morgann Riu does not guarantee any particular outcome from following a course. The buyer remains solely responsible for the use they make of the knowledge acquired.

In any event, Morgann Riu's liability is limited to the amount of the order concerned.

Personal data

As part of a purchase, the following data is collected:

  • Email address: to send course access details and communications relating to the order
  • Name: to issue the invoice

This data is processed in accordance with the General Data Protection Regulation (GDPR) and is never sold to third parties for commercial purposes. Payment data is processed exclusively by Stripe and is not stored on our servers.

Complaints

For any complaint relating to an order, the buyer may contact Morgann Riu:

Morgann Riu undertakes to acknowledge receipt of any complaint within 48 hours and to provide a response as soon as possible.

Mediation

In accordance with Articles L.612-1 et seq. of the French Consumer Code, in the event of a dispute that is not resolved directly with Morgann Riu, the consumer may refer the matter free of charge to a consumer mediator.

The competent mediator is:

Applicable law and competent jurisdiction

These Terms are governed by French law.

In the event of a dispute and failing an amicable resolution or mediation, the dispute will be brought before the competent courts of Perpignan.

Amendments to the Terms

Morgann Riu reserves the right to amend these Terms at any time. The applicable Terms are those in effect on the date of the order. Any substantial change will be indicated on the website.
